Trademarks and service marks are recognizable names, logos, designs, or expressions that identify a product or service as being from a particular source. Trademarks and service marks may be registered with state and/or federal authorities, and registration provides certain advantages in enforcing a mark against infringers. The use of an unregistered mark in a manner that creates a likelihood of customer confusion may give rise to liability, as well. Pharmaceutical trademarks pose potential issues, too, as they must meet required specifications established by regulatory authorities.

In addition, we will handle registration proceedings in the United States and, with the assistance of our foreign agents, in other countries around the world. We can assist with trademark appeal and opposition proceedings before the Trademark Trial and Appeal Board, and appeals to the U.S. Court of Appeals for the Federal Circuit. For example, we recently won an appeal to the Federal Circuit in a case where a competitor had opposed registration of our client’s trademark.
